A high court hearing a case involving the national chairman of the main opposition National Democratic Congress (NDC), who is charged with two counts of assault on a public officer, has thrown out an application by Mr Samuel Ofosu-Ampofo’s lawyers in which they prayed the court to strike out the charges.
Mr Ofosu-Ampofo’s lawyers argued that the charges had no basis and that the prosecution team failed to spell out the particulars of same.
The court, presided over by Justice Samuel Asiedu, on Friday, 7 June 2019 ruled that not only were the charges recognised by the law but also that the defects pointed out by the defence team did not pose any fatality to the process.
He, therefore, directed that the case start on 8 July 2019.
Mr Ofosu-Ampofu has pleaded not guilty to the charges and is on a GH¢100,000 bail.
Following some gun violence that marred the Ayawoso West Wuogon by-election in February this year, Mr Ofosu-Ampofo was captured on audiotape allegedly inciting his party’s communication members against the Chairman of the National Peace Council, Prof Emmanuel Asante and the Chairperson of the Electoral Commission, Mrs Jean Mensa.
